Deputy Prosecutor Maxie Kizer said during the court hearing that normally the offense would be a third-degree domestic battery but because of the age of the victim, the charge becomes second-degree.

Reading from a probable cause affidavit from Detective Chris Wieland, Kizer explained what happened.

Handy was not interviewed after he said he did not understand his rights. He was ordered to have no contact with the victim until the case is settled.
