A lawsuit contending that District 8 Justice of the Peace Roy Agee does not live in his district has been filed by Justice of the Peace Lloyd Franklin Jr., who has faced the same claims about his residence.
The six-page lawsuit, along with multiple exhibits also names Arkansas Secretary of State John Thurston in his official capacity and the State Board of Election Commissioners.
According to the lawsuit, Agee listed his residence as 6803 Oxford Road, but moved out of that residence when he separated from his wife in May of 2021. He and his wife divorced in September and she was awarded the house in the divorce settlement.
The lawsuit also claims that Agee has used several addresses (of known associates) in the district but has no residential or domicile ties other than listing them on his 2022 campaign contributions and expenditures report. One of those addresses, 7111 Cambridge, is owned by Shawn Womble, according to a report from the Jefferson County Assessor’s Office. That address is the one Agee allegedly uses for the position he holds on the White Hall School Board as well as the position he is seeking reelection to.
The lawsuit seeks to have Agee’s name removed from the ballot for the Nov. 5 General Election or from counting any votes he receives.
It also demands an expedited court hearing to hear and determine this case.
